This policy explains how ARP Cloud Solutions handles your personal information, in line with the Protection of Personal Information Act 4 of 2013 (POPIA).

1.Who is responsible for your information
ARP Cloud Solutions is the responsible party for personal information collected through https://arpcloudsolutions.co.za and while providing our services. Legal status: Sole proprietor (Mohammed Raaziq Parker trading as ARP Cloud Solutions). Our address is 2 Rupert Street, Panorama, Cape Town, South Africa.
This policy explains what we collect, why, who we share it with, and your rights under the Protection of Personal Information Act 4 of 2013 (POPIA). Our Information Officer is Mohammed Raaziq Parker, who can be reached at contact@arpcloudsolutions.co.za.
2.What we collect
We collect information directly from you, and from PayFast when you pay online. We only collect what we need:
- Contact details: your name, email address, phone or WhatsApp number, and your business name or website.
- Enquiry and project details: what you enter in our quote form, project estimator, contact form or beta-tester form, including budget and timeline.
- Client project records: quotes, invoices, payments received, milestones and updates in your client dashboard.
- Reviews: if you leave a review through your client dashboard, your name, role, company and review.
- Payment information: when you pay online, PayFast tells us the amount, date, payment reference and the name and email address used. We never receive or store card numbers or banking passwords.
- Device and repair details: the make and model of devices you bring to us and the fault. We only open files on a device where that is needed for the repair or recovery you asked for.
- Technical information: your IP address, used briefly to protect our forms from abuse, and standard server logs kept by our hosting provider.
Giving us your information is voluntary, but without your contact details we cannot reply to you, and without the details of your project or device we cannot quote for or provide the service. No law requires you to give us your information, other than the records tax law requires us to keep for payments.
3.Why we use it
We use your information to:
- reply to your enquiries and prepare quotes;
- deliver, manage and support the services you ordered, and send you project updates;
- issue invoices, take payments and keep financial records;
- publish reviews you have submitted for publication;
- keep our website and forms secure and prevent fraud and abuse; and
- meet our legal obligations, such as tax record-keeping.
We process your information because it is needed to take the steps you ask for or to perform our agreement with you, because the law requires it, with your consent (for reviews), or for our legitimate interest in running and protecting our business, as section 11 of POPIA allows.
We do not sell your information and we do not make decisions about you by automated means alone. We only send you marketing if you have agreed to receive it (section 69 of POPIA), and you can opt out at any time.
5.Information sent outside South Africa
Some of our providers store data outside South Africa, including in the United Kingdom, the European Union and the United States. We only use providers that are bound by data protection laws or contract terms that give protection substantially similar to POPIA, as section 72 of POPIA requires.
6.How we protect it
We protect your information with measures that include encrypted connections (HTTPS) across the whole website, password-protected admin access limited to us, keys and passwords stored outside the website code, and online payments taken on PayFast's own secure pages. Our providers are required to keep the information they process for us secure and confidential.
If we become aware of a security compromise that affects your information, we will notify you and the Information Regulator as soon as reasonably possible, as section 22 of POPIA requires.
7.How long we keep it
- Enquiries and quotes that do not become projects: up to 24 months, then deleted.
- Client project records, invoices and payment records: 5 years, as the Tax Administration Act 28 of 2011 requires.
- Reviews: for as long as they are published, or until you ask us to remove them.
- Beta-tester applications: until the testing programme ends, plus 12 months.
- Files on devices brought in for repair: we do not keep copies after the device is returned, except data-recovery copies you ask us to hold, which we delete 30 days after handover.
After these periods we delete or anonymise the information.
9.Your rights
Under POPIA you have the right to:
- ask whether we hold information about you and request a copy of it (section 23);
- ask us to correct or delete information that is inaccurate, out of date, excessive or unlawfully obtained (section 24);
- object to processing based on our legitimate interests, and to direct marketing (section 11(3));
- withdraw your consent where we rely on it, for example to have your review removed; and
- lodge a complaint with the Information Regulator.
To make a request, email contact@arpcloudsolutions.co.za. We may ask you to confirm your identity, and will respond within 30 days. There is no charge for correcting or deleting information. Some requests may be limited where the law requires us to keep records, such as tax records.
10.Complaints to the Information Regulator
If you are not satisfied with how we handle your information, please contact us first. You may also lodge a complaint with the Information Regulator of South Africa: https://inforegulator.org.za, email POPIAComplaints@inforegulator.org.za.
11.Children
Our services are aimed at businesses and adults. We do not knowingly collect information about children under 18 without the consent of a parent or guardian.
12.Changes to this policy
